Short Stay Terms & Conditions

By booking accommodation with 53 Degrees Management Ltd ("53DM"), you agree to the following terms and conditions.

1. The Booking

1.1. Your booking is with 53 Degrees Management Ltd ("53DM"), a Limited Company registered in England and Wales (No. 15122283). Our head office is The Studio C/O Cheshire Accounts Services Ltd, Baddiley Lane Farmhouse, Baddiley Lane, Baddiley, Nantwich, Cheshire, CW5 8BP.

1.1.1. Definition of a Guest. A "Guest" is any person or party who: completes a booking through 53DM or an approved third-party platform; submits all required documentation (including valid ID); and either (a) successfully makes full payment, or (b) receives formal written confirmation from 53DM of an alternative arrangement. No person shall be deemed a valid Guest until all of the above have been completed. Any access to a property granted on the basis of falsified, incomplete, or fraudulent information is unauthorised. 53DM reserves the right to notify the police and pursue legal action in such cases.

1.2. References to "you" or "your" are references to the person or organisation making the booking with 53DM.

1.3. These terms apply to all bookings made through the 53DM website (www.53degreesproperty.com), by email (bookings@53degreesproperty.com), by telephone or in person. Bookings via Booking.com, Airbnb or VRBO are also subject to these terms; however, those platforms' terms take precedence where there is a dispute. Availability seen at the time of enquiry cannot be guaranteed.

1.4. Your booking is confirmed and a legal contract concluded once your payment has been successfully made. No booking is made when payment is declined or unauthorised.

1.5. You agree that the booking is for a short term stay for leisure, business or temporary purposes and does not give rise to an assured shorthold tenancy or lease. It is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977.

1.6. Bookings can be from one night up to three months (longer stays must be agreed with the company director) and may be made up to 9.00pm on the first night of your stay.

1.7. Bookings may only be made by a person aged 18 or above, and at least one person aged 18 or above must stay in the accommodation.

1.8. You may not resell or re-assign your booking to any other person or organisation without the express authority of 53DM.

2. Payment and Cancellations

2.1. All payments shall be made by credit/debit card or bank transfer. 53DM does not charge booking fees or card fees.

2.1.1. Payment by credit/debit card is preferred for online bookings via 53degreesproperty.com.

2.1.2. Bank Transfer (BACS) is preferred for phone bookings. Account Holder: 53 Degrees Management Ltd. Sort Code: 04-00-03. Account Number: 94780516. Bank: Monzo Bank. Reference: Guest surname + check-in date (DDMMYY), e.g. SMITH010120. Cash or cheque payments are only accepted in exceptional circumstances with prior approval. Post-dated cheques are not accepted.

2.1.3. Confirmation of Booking. Bookings are only confirmed and legally binding once: full payment is received (or verified alternative method); the online check-in form is completed with valid ID verification; and these Terms are agreed. A booking is invalid if payment is not received or is later found to be fraudulent.

2.2. Full payment is required upon booking unless expressly agreed otherwise (or payment is taken via an online travel agent).

2.3. The total price for your stay is presented before you confirm. Our pricing is dynamic; once booked, no additional payment is required if prices rise, and no discount is given if prices fall.

2.4. For bookings made direct with 53 Degrees Property (phone, email, direct booking website or Vrbo), the cancellation policy is:

  • If the booking is under 5 days long: cancel 5 days before check-in for a full refund.
  • If the booking is 5–14 days long: cancel 7 days before check-in for a full refund.
  • If the booking is 14+ days long: cancel 14 days before check-in for a full refund.
  • If you cancel within 24 hours of booking, you receive a full refund.
  • A small refund processing fee may apply to all cancellations.

(For bookings made via Airbnb, Booking.com etc., the cancellation policy is as stated on your booking confirmation.)

2.5. Both 53DM and you may cancel up to 28 days prior to the first day of the booking with a full refund. A small refund processing fee may apply to direct bookings.

2.6. 53DM reserves the right to cancel bookings within 5 days of the first day where necessary due to reasons outside its reasonable control or overbooking due to system errors. A full refund will be made.

3. Your Stay

3.1. Check-in is from 3pm; check-out is no later than 10am unless agreed otherwise. 53DM may charge for early check-in or late check-out.

3.2. 53DM provides serviced accommodation, not a hotel or guest house. We do not provide meals or newspapers.

3.3. One set of linen and towels is provided per stay (mid-stay changeover for stays over 7 nights). A cleaning service is provided; further information on request.

3.4. You are responsible for the conduct of all persons staying in the accommodation. You and your guests must not:

  • 3.4.1. Smoke on the premises (all rooms and common areas are strictly non-smoking).
  • 3.4.2. Bring pets onto the premises, except assistance dogs or as expressly agreed.
  • 3.4.3. Bring dangerous or hazardous materials, equipment or illegal substances.
  • 3.4.4. Tamper with any fire alarms or emergency equipment.
  • 3.4.5. Remove, damage or destroy any 53DM property.
  • 3.4.6. Use 53DM technology to access unlawful or obscene material.
  • 3.4.7. Cause unreasonable disturbance to other guests or staff.
  • 3.4.8. Make excessive noise, particularly after 10pm.
  • 3.4.9. Fail to return keys/fobs/cards at the end of your stay.
  • 3.4.10. Remove or use extra linen from the locked linen cupboard without contacting guest services.
  • 3.4.11. Charge an electric car using the main power supply without prior arrangement (additional energy charges will apply).

4. Damage, Theft and Costs

4.1. 53DM reserves the right to charge the credit/debit card used for payment (or any other card provided as security) for:

  • 4.1.1. The cost of replacing or repairing 53DM property (furniture, upholstery, fittings, appliances or fixtures) damaged during your stay.
  • 4.1.2. The cost of replacing items stolen during your stay.
  • 4.1.3. Breach of the non-smoking policy: a standard charge of £1,000 will be applied where smoking is evidenced, plus any additional damage costs.
  • 4.1.4. Use, sale or misuse of illegal substances: a standard charge of £1,000 applies where evidence or suspicion exists, plus additional reasonable costs.

4.2. Such costs may be charged on check-out but 53DM reserves the right to apply charges at a later date where necessary.

4.3. If 53DM is unable to charge the card, an invoice will be sent, which you agree to pay within 14 days of receipt.

4.4. A receipt with a breakdown of any additional charges will be provided.

4.5. Loss of 53DM property and other potential additional charges:

  • Lost keys – £150.00
  • Lost apartment fob – £150.00
  • Lost car park fob – £150.00
  • Lost parking permit – £100.00
  • False emergency call-out (outside working hours) – £150.00
  • Excessive cleaning – £30.00 per hour
  • Disruption / noise complaints / disruptive social gatherings – £100.00
  • Inappropriate items flushed down the toilet – £150.00
  • Early check-in (before 3pm) – £20/hr
  • Late check-out (after 10am) – £20/hr
  • Damaged items, decor, furniture or fittings – case by case to cover repair/replacement
  • Extra linen – £50.00

Any outstanding or additional charges related to the booking will be debited from the card on profile.

4.6. Where a refundable damage deposit is requested (whether booked direct or via an OTA), you may choose:

(a) Pay a refundable damage deposit of £350, collected via online payment link and returned within 7 days of check-out following inspection (deductions per clauses 3–4.5); OR

(b) Pay a non-refundable damage waiver fee of £25 per night up to a maximum of £110. This reduces your liability for accidental damage to a maximum of £50. Damages exceeding £350 will be charged to your card. The waiver only covers accidental damage reported during your stay and does not cover intentional damage, misconduct, gross negligence, breach of house rules, loss or theft of property, damages from unauthorised activities (smoking, parties, illegal acts), excessive cleaning, or pet-related damage.

4.7. Extra cleaning policy. For long-term bookings (10+ nights), weekly cleaning and linen changeovers are required at an additional cost. By agreeing to these terms, you accept this policy.

4.8. Guest Liability for Pest Infestation. If a pest infestation (including bed bugs, cockroaches, fleas or other parasites) is discovered during or after your stay, 53DM reserves the right to investigate the source and charge the Guest for: professional pest control treatment; replacing affected furniture, linen or other items; and loss of income during required treatment and downtime. If evidence or professional advice indicates the infestation was introduced via the Guest's belongings or conduct, the Guest is fully liable. Costs may be deducted from the card on file or billed separately.

5. Privacy, Data Protection, Card Security & Security Devices

5.1. 53DM processes information you provide during booking and check-in in accordance with our privacy policy. By providing this information you consent (on your behalf and that of your group) to such processing and warrant the information is accurate.

5.2. We are required by law to maintain a register of all guests' names and nationality on arrival and keep these details for at least 12 months. For guests who are not British, Irish or Commonwealth nationals, we are required to take passport details and the address of your next destination.

5.4. We use Stripe (stripe.com/gb), a PCI-DSS compliant service, to process card payments. We do not store any copy of your card details. Stripe's privacy policy: stripe.com/gb/privacy.

5.5. We use security cameras / audio recording devices on all our premises, located at the front of the property to monitor the entrance. In accordance with the Data Protection Act, all guests are made aware of these devices via the listing page at the time of booking.

5.6. We use noise monitoring devices inside our premises to avoid disturbance of neighbours and ensure compliance with these terms. These devices monitor noise levels only and do not record sound.

6. Complaints

6.1. 53DM wants to ensure you have an enjoyable stay.

6.2. If you have a problem during your stay, please talk to any member of staff.

6.3. If a complaint cannot be resolved informally, you may submit a formal written complaint with full details using the contact information below.

6.4. Formal complaints are handled by a member of the 53DM management team. We aim to respond within 2 days; if not possible we will notify you of the expected response time. The outcome will be set out in writing.

6.5. 53DM reserves the right to reject without further investigation any vexatious complaint or one made in bad faith.

7. Limitation of Liability

7.1. 53DM's liability to you is limited to the total value of your booking (unless the Hotel Proprietor's Act 1956 applies, in which case liability is limited to the maximum prescribed under that Act), except where loss is caused by our negligence, in which case it is limited to any direct and reasonably foreseeable loss.

7.2. 53DM shall not be liable for any consequential or indirect loss including loss of profit, data, management time, reputation or goodwill.

7.3. 53DM shall not be liable for damages or loss caused by conditions or events beyond its control, including: strike, lockout or labour disputes; acts of God; natural disasters; acts of war or terrorism; acts or omissions of government, highway authorities or telecommunications carriers; delay in manufacture, production or supply by third parties.

7.4. Nothing in these terms limits 53DM's liability for death or personal injury or for fraudulent misrepresentation.

8. Severability

8.1. If any provision of these terms is held invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity and enforceability of the remaining provisions shall not be affected.

9. Waiver

9.1. Failure by any party to require performance or to resort to any remedy at any time shall not affect the right to require performance or remedy thereafter. A waiver is only effective if in writing and signed by the party against whom it is enforced.

10. Entire Agreement

10.1. These terms constitute the entire agreement of the parties and supersede all prior communications, understandings and agreements, whether oral or written.

11. Guest Obligations

11.1. The Guest has the right to occupy the property for the period defined on their booking confirmation. The Guest agrees:

11.2. Not to permit overnight accommodation for any guests other than those declared to 53 Degrees Property in advance, and not to permit any visitor to stay overnight without prior written consent.

11.3. To pay for any losses or damage caused to the property.

11.4. To take good care of the property and leave it clean and tidy at the end of the stay.

11.5. To permit the Owners and 53 Degrees Property reasonable access. Cots may only be occupied by children aged 24 months or less; 53 Degrees Property is not responsible for cot maintenance and the Guest must supply their own cot linen.

11.6. Not to cause annoyance or nuisance to occupants of adjoining premises, including:

  • 11.6.1. No noise between 10pm and 8am.
  • 11.6.2. No smoking in the property or any associated public areas.
  • 11.6.3. Check the listing or confer with 53 Degrees Property before bringing pets.
  • 11.6.4. Read all safety notices on arrival.
  • 11.6.5. No re-letting or subletting.
  • 11.6.6. Use the property strictly for residential purposes.
  • 11.6.7. No parties or gatherings — entry will be refused if intent is suspected.
  • 11.6.8. No use of any phone or fax line connected to the property.
  • 11.6.9. No fires or candles in the property.
  • 11.6.10. No running a business from the property.
  • 11.6.11. No parties — breach incurs a £2,000 charge.
  • 11.6.12. Do not hang wet or damp washing on any room heater.
  • 11.6.13. The property may not be used as a permanent residence.
  • 11.6.14. Do not use more linen than supplied without confirming with 53DM guest services.
  • 11.6.15. Do not engage in any illegal activity on the premises.

11.7. In the event of breach, the Guest will be required to leave immediately and no refund will be given.

11.8. The Guest must provide full names of all individuals staying and may be required to present valid photo ID. Undeclared occupants incur a £200 charge and the relevant public authorities will be informed.

11.9. The Guest is responsible for ensuring the property is not occupied by more people than stated on the booking confirmation. 53 Degrees Property reserves the right to refuse admittance if this condition is likely to be breached, with no refund.

11.10. In an emergency, the Guest should: use the fire blanket and/or extinguisher if appropriate; leave belongings and exit swiftly, assisting anyone who needs help; wait on the main road away from the building and call 999 quoting your location. Our contact number is +44 (0) 330 058 0165.

11.11. By agreeing to these terms, you acknowledge that you are not protected from the Protection from Eviction Act 1977.

12. Third Party Rights

12.1. Nothing in this Agreement is intended to, nor shall, confer any rights on a third party unless expressly provided otherwise.

13. Jurisdiction

13.1. This Agreement shall be construed in accordance with English law and the Courts of England and Wales shall have exclusive jurisdiction over any matter arising from it.
